Healthcare professionals impacted by widespread flu

On December 19 2013, the New York State Health Commissioner declared the influenza virus widespread, requiring unvaccinated healthcare professionals (HCP) to wear a face mask while working with patients. This requirement is a result of the February 7 2013 regulation asking that all HCP’s be vaccinated against influenza or be required to wear a facemask when the virus is considered widespread.

This declaration follows the CDC’s own report of widespread flu activity in New York State. Even though the widespread declaration is considered statewide, only 34 counties reported flu activity in the week of 12/14.

Deputy Commissioner of the Office of Public Health Dr. Birkhead reports that the declaration will last for several months until flu activity is no longer prevalent. Dr. Birkhead also reported that approximately 60% of health care workers have been vaccinated so far, a higher rate compared to last year.

HCP’s who are not yet vaccinated can still protect themselves and not be required to wear a facemask.

In a press release, State Health Commissioner Nirav R. Shah addresses workers reminding them that, “New Yorkers who have not been vaccinated for influenza that it’s NOT too late to get their annual vaccination.”

A NY Department of Health FAQ on 9/24/13 states that the mask wearing enforcement is not required for workers vaccinated during the declaration, stating “it is not required that persons wear a mask during the weeks immediately after vaccination”.

This declaration also comes as the Public Employees Federation Union filed a challenge to the regulation on 11/26/13 in New York State Supreme Court. The union argues that a facemask does not prevent the spread of the virus, may increase contamination, and impairs communication with patients.

Since September 2013, Mobile Health, an employee screening provider in New York City, opened their doors after business hours and offered on-site vaccination programs to encourage universal vaccination. Mobile Health will continue to offer the flu vaccine during the widespread declaration for employees who do not want to wear the facemask.
